Yemen revokes Indian nurse Nimisha Priya's death sentence?

The execution was earlier stayed on the intervention of the Grand Mufti. It was originally scheduled for July 16 but temporarily halted. Nimisha was convicted of a Yemeni's murder.

SANAA (Yemen), July 29: Indian nurse Nimisha Priya's death sentence has been revoked by Yemen, according to Indian Grand Mufti’s office. She was convicted of a Yemeni's murder and awaiting execution.

The office of Sunni scholar Kanthapuram AP Aboobacker Musaliyar said in a statement on Tuesday that his efforts to mediate the release of Nimisha Priya on death row in Yemen by payment of diya, or blood money, have been successful.

The execution was earlier stayed on the intervention of the Grand Mufti. It was originally scheduled for July 16 but temporarily halted.

The mediation with the family of the deceased Yemeni national, Talal, was done by a delegation of Yemeni scholars appointed by Sheikh Umar Hafiz Thangal at the request of the Grand Mufti.

Diyah, or blood money, is a provision under Islamic law that allows victims’ families to pardon the accused in exchange for monetary compensation.

However, the Indian Ministry of External Affairs (MEA) has not confirmed the development.

Execution postponed

The Backstory: In a dramatic turn of events, Yemen on July 15 postponed the execution of Nimisha Priya, a 36-year-old nurse from Kerala, India, who was convicted of murdering her Yemeni business partner, Talal Abdo Mahdi, in 2017.

Originally scheduled for July 16, the execution was deferred following intense diplomatic efforts and community-level negotiations. The Indian Government, which has been actively involved in the case, confirmed that it had reached out to influential sheikhs and local prosecutors to seek a temporary suspension.

Priya, currently imprisoned in Sanaa Central Jail, has been on death row since 2020. Her final appeal was dismissed in 2023, and the execution was approved by Yemen’s Supreme Political Council earlier this year.

The postponement comes amid ongoing talks between Priya’s family and Mahdi’s relatives, with hopes of reaching a blood money settlement—a provision under Yemen’s Sharia law that allows the victim’s family to pardon the accused in exchange for financial compensation. The NGO, Save Nimisha Priya – International Action Council is spearheading these negotiations, reportedly offered USD 1 million to Mahdi’s family.

Prominent religious leaders, including Kanthapuram AP Aboobacker Musliyar, India’s Grand Mufti, have also intervened, facilitating discussions with Yemeni scholars and Mahdi’s family in Dhamar.

The postponement offers a glimmer of hope for Priya and her family and supporters, though the situation remains delicate and far from resolved.

What Supreme Court said

NEW DELHI: The Central Government told the Supreme Court on Monday (July 14) that it was making “all possible efforts" to save Nimisha Priya, a nurse from Kerala sentenced to death in Yemen on murder charge. She is scheduled to be executed on July 16.

“Nothing much can be done," Attorney-General R Venkataramani told the apex court during a hearing on a plea seeking direction to the Centre to use diplomatic channels to save her.

“All possible efforts are being made, but nothing much can be done. Not much can be done as far as Yemen is concerned," he said.

Nimisha Priya (38), a nurse hailing from Kollengode in Palakkad district of Kerala State, moved to Yemen in 2008 to support her family and started working as a nurse in a private hospital. In 2011 her husband and daughter joined her but returned to India in 2014 due to the outbreak of civil war.

She opened a clinic in 2015 with Yemeni national Talal Abdo Mahdi as a mandatory local partner under Yemeni law.

The crime and conviction: In July 2017, Priya allegedly attempted to sedate Mahdi to retrieve her seized passport. The sedative overdose led to his death. With help from another nurse, Mahdi’s body was dismembered and hidden in a water tank. Priya was apprehended while trying to flee Yemen. The trial was conducted entirely in Arabic, reportedly without translation or legal counsel for Priya. Death penalty was handed down in 2020 and it was upheld by Yemen’s Supreme Judicial Council in 2023.

Allegations of abuse: Priya’s family and supporters claim Mahdi physically and sexually assaulted her and seized her passport and misappropriated clinic funds. He allegedly forged documents to show they were married. She was reportedly forced to sign several confessional statements in Arabic, which led to her conviction.

Diplomatic efforts: The Indian Government has reached its diplomatic limits due to Yemen’s lack of formal recognition and the region being under Houthi control, it was stated.

Blood money negotiations: As per Sharia Law, the victim’s family can pardon the accused in exchange for diya (blood money). Priya’s family and supporters made an offer of $1 million (Rs 8.5 cr). The victim’s family reportedly rejected the offer, citing “honour.”

Her mother Prema Kumari is currently in Yemen trying to negotiate the pardon. Her daughter, 12-year-old Michele, lives in a convent in Kerala. Her father is an auto driver.

A support group called Save Nimisha Priya International Action Council is coordinating legal and fundraising efforts.

Final window of hope: The only remaining option is a last-minute pardon from the victim’s family.

The Supreme Court of India has urged the Centre to explore informal channels.

PROGNOSIS: It looks a Real New Trump is emerging - courageous, balanced, powerful and disinterested. Determined to save his country from the cliff, he has done quite a few draconian things that will reduce the burden of debts of the Federal entity, like the golden handshake, stopping senseless funding, pulling out of a worthless WHO. Shutting the Education Department is another. On the other hand, running it is also not the Centre's job either (We will convincingly elaborate it in the next chapter).

In India the scene is just the opposite. Centralisation is the core agenda and identity of the ruling dispensation without which it has no existence, or in other words, it exists for that set of schemes only. A realisation of this never dawned upon any Opposition party in 2014 or any time thereafter, what to talk of being able to see it coming 70 years ago! The consequence of all this violation of basic natural law of the universe we cannot predict.

THE AMERICAN CONUNDRUM: Political venom has migrated to top echelons in the US. It was reported last year NASA has become politicised, vitiated. But NASA refuted the charge. How Boeing developed a glitch but its unmanned return was smooth. When Suni-Wilmore were stranded last June, why the return was set for February? Because that comes only after January 20! SpaceX called the shots, for itself and for Trump. Then the mission was manipulated for March for a better bargain! In between, what made Elon Musk 'predict' during campaign if Kamala Harris wins he would be in jail. In politics, it is said, "the only rule is there are no rules." Difficult times for Americans too.

The terminations are part of a large-scale exercise going on all across Fed departments and organisations to reduce wasteful Government expenditure as decided by a Trump in a mess gone berserk, and improve administrative efficiency following the whims of billionaire and his associate Elon MusK and his DOGE. It has not been shared how terminations are going to raise the efficiency bar! It looks like Trump has stolen some of the prescriptions meant for India. But the American problems are quite different.

Suddenly these colonial clerks feel this effortless, little rule will tremendously enhance security and convenience for the railway passengers manifold. More stations will be covered in the next 77 years! (Also See: New Delhi station stampede... What went wrong?)

ANALYSIS: "The standard operating procedure for deportations by aircraft used by ICE that is effective from 2012 provides for the use of restraints," says the Government. That means, it is taken for granted the US will set the standard for deportations. For another, the Government is more interested in comparing with what happened in 2012 under a different Government to justify its own compliance! No surprise, others are trampling upon us. (How we conduct ourselves inside decides, inherently, how we are treated outside) Thirdly, the Government blamed the gangs doing the business of human trafficking for the illegal migration. For all the crimes taking place in the country, let us blame the criminals! Funny! We will never move an inch forward! The mindset defines what we are.

Meanwhile, a UN-returned Congress leader Shashi Tharoor sounded like a layman when he said, "If they are citizens of India we have an obligation to take them back." Who said 'No'?. He should know that is not the issue now. Who will identify an undocumented person, and how?

OPINION: A nutty 'new' Trump must know checking illegal immigration is his job and not theirs. And 'penalty' tariff is not a solution. However, Trump talking about "major threat" from "illegal aliens" (illegal immigration) is about what he believes, right or wrong, and to that extent he is genuine and honest; it is certainly not a pretension to prop up his political relevance. Bullies are always true to themselves. Look at India's crooked politicians shouting day in, day out to prove they are more patriotic, and to whip up public sentiments for them to ride on!

The function was held indoors from 12 pm (10:30 pm IST) at the rotunda of the US Capitol building because of unusually intense cold and snow. Delivering his inaugural address, Trump remarked, “The golden age of America begins right now," and just hours later signed a slew of executive orders to redeem the election pledges.
