WASHINGTON, Dec 24: The Trump administration has replaced the random lottery system for H-1B visas with a new system which will select the applicants based on higher salaries and qualifications. The visa fee has also been changed from the present $2,000-$5,000. It will now cost the employers $100,000 per applicant.

The change—the "weighted selection process"—will take effect on February 27 next year and the first batch will enter the US in 2027 financial year—H-1B e-registrations typically open in March—the Department of Homeland Security (DHS) announced in a statement on Tuesday. The draft rules and the new fees were announced in September.

The change is part of an ongoing overhaul of the existing immigration system that intensified the crackdown on all types of legal and illegal immigrants by the Trump administration.

The existing H-1B system weighs in favour of low-paid workers largely depriving American workers of their wages and jobs, according to President Donald Trump.

The new system will put in place a program to "implement a weighted selection process that will increase the probability that H-1B visas are allocated to higher-skilled and higher-paid" applicants", the DHS said in a statement.

A Level IV wage offer, the highest, would be entered into the lottery system four times and, retrogressively, Level I only once (as selected on the registration form - "salary is generally a reasonable proxy for skill level") meaning the highly qualified and paid will get four times the chance. Under the present system all will get equal chances. New graduates will have little chance now.

New wage level requirement

The Department of Labour (DOL) will set the new wage level requirement. In summary, applicants offered higher salaries will have a better chance. The visas go to the “the best and brightest.”

The H-1B program allowed US employers to recruit foreign workers in specialised fields for a fixed duration of about 4-5 years at lower wages. The visa fee that was $2,000 to $5,000 will now cost the employers $100,000 per applicant.

The Unites States Citizenship and Immigration Services (USCIS) said the random process was abused in favour of lower wage workers, and the new system will ensure greater protection for the American worker.

The annual quota for H-1B visa is 85,000—65,000 regulars and 20,000 for US advanced degree holders. In 2024, 80,449 of the 1.41 lakh H-1B approvals (57%) (buffer) were for Indian applicants.

As part of the overhaul, the US State Department recently began enhanced screening and vetting of H-1B and dependent H-4 visa applicants like social media profiles. This also added to the hassles of existing visa holders currently on travel.

The USCIS statement said:

ANALYSIS: "The standard operating procedure for deportations by aircraft used by ICE that is effective from 2012 provides for the use of restraints," says the Government.
