NEW DELHI, Nov 2: The Kerala Government on Thursday filed a petition before
the Supreme Court against Governor Arif Mohammed Khan for delay in clearing
the Bills passed by the State Assembly. The petition asserted that he is violating
the provisions of the Constitution.
The petition pointed out inaction on the Governor's part regarding eight Bills
passed by the State legislature and presented to him for his assent under Article
200 of the Constitution. There are Bills pending with him since November 2021.
The pending Bills include the University Laws Amendment Bill, the Kerala Co-operative
Societies Amendment Bill, the Kerala Lokayukta Amendment Bill and the Public
Health Bill.

With this, Arif Mohammed Khan will be the fourth Governor to face similar petitions
in the top court alleging delay in clearing of Bills, after Tamil Nadu Governor
RN Ravi, Punjab's Governor Banwarilal Purohit and Telangana Governor Tamilisai
Soundararajan.
They pointed out the obstructive, anti-constitutional role played by the respective
Governors.
Earlier this week, the Tamil Nadu and Punjab Governments had approached the
apex court against their Governors over delay in clearance of Bills passed by
the respective Assemblies.
The Tamil Nadu Government filed a petition in the Supreme Court on Monday alleging
that the Governor is creating a “constitutional deadlock” by holding up or not
giving consent to the Bills passed by the Assembly and orders issued by the
Government leading to administrative problems in the State. He is obstructing
the Assembly and the Government's work.by delaying consideration of the Bills.
Referring to RN Ravi's inaction in assenting Bills, the petition said that
the "Governor is acting as a political rival":
The Tamil Nadu Government has pleaded that the ‘inaction, omission, delay and
failure to comply with the constitutional mandate by the Governor’ is illegal
and arbitrary.
The Government urged the court to direct the Governor to give assent or dispose
of Bills within a specified time frame under Article 200 of the Constitution.
It alleged that Governor RN Ravi is intentionally delaying the Bills.
MK Stalin and RN Ravi have been at loggerheads over the issue for the last
two years. Two of the major issues were the NEET exemption Bill and the appointment
of PSC chairman.
Twelve Bills, four prosecution sanctions and files relating to the premature
release of 54 prisoners are currently pending before Governor Ravi, the petition
stated. The Governor had also raised a controversy by proposing that 'Thamizhagam'
would be a more appropriate name for 'Tamil Nadu.'
In April last, on a similar petition filed by Telangana Government against
the State Governor, the Supreme Court had observed that the Governors should
return the Bills "as soon as possible" in terms of Article 200.

Experts blame violation of the Visual Flying Rules (VFR) for most of the
chopper crashes in the mountains as the leading cause. VFR means fly only
visually - because of the lack of navigation aids in remote areas or unreliability
of GPS-like aids in hilly terrains or a remote manipulation of instruments
in cases of sabotage - as the topography plays havoc especially in the monsoon
(mid-June to September).
Even when VFR is followed, most crashes occur due to CFIT (Controlled Flight
into Terrain) - that is, everything else is OK but the aircraft collides with
hills or trees hidden by the clouds. This also occurs mostly in the monsoon.
On Tueday with Manang, the chopper was brand new, pilot was highly experienced.
But it hit an 'invisible' tree and then crashed against a hillside. This
CFIT occurred when the pilot tried to dodge patches of clouds even as he was
following the VFR.
Simply put, everyone knows flying in the hills during the monsoon is risky,
but the companies want to make more money in any which case. This type of
tragedy is very frequently invited in the Indian hill State of Uttarakhand
as well, where pilots are even made to fly without the mandatory rest.
