Advani too will be prosecuted in Babri demolition

     Lucknow: The Lucknow bench of the Allahabad High Court today quashed the Rae Bareli court order which acquitted BJP president and former Deputy PM Lal Krishna Advani in the Babri Masjid demolition case. Setting aside the special court order, the High Court bench asked Advani to produce himself before the Rae Bareli special court on July 28. It said that he will be prosecuted against like other accused in the case. The other accused in the case include former union ministers Murli Manohar Joshi, Uma Bharti, VHP leaders Vishnu Hari Dalmiya, Giriraj Kishore, Ashok Singhal, Sadhvi Rithambra, and BJP leader Vinay Katiyar. In his first reaction to the HC order, Advani reiterated his wish of constructing the Ram temple at the disputed place at Ram Janambhoomi Babri Masjid compound. The Rae Bareli special court, which has been hearing the case, had in September 2003 absolved Advani of the charge in the demolition case. Thereafter, rest of the seven rightist leaders facing trial in the case had appealed for reprieve before the HC. Today's HC verdict poured cold water on BJP and Sangh Parivar's attempt to once again raise the Ram temple issue after yesterday's terrorist attack on the temple in Ayodhya. As a mark of protest, the rightist parties had called for a countrywide bandh which evoked partial response. While many top leaders from the BJP and other rightist parties were arrested from different parts of the country, rail, road and air services were disrupted at some places.

Three out of 13 Tihar escaped inmates caught  (Go To Top)

     New Delhi: Delhi Police caught three runaway prisoners who escaped from Tihar Jail along with 10 others. All the 13 undertrial prisoners were escaped late this morning when they were produced before the court inside the Tihar Jail premises only. "These prisoners were produced before court inside the Tihar Jail premises, who somehow managed to open the latch of cell they were kept inside and runaway taking advantage of bushes around the court," said Deepak Mishra, Joint Commissioner Delhi Police. "We got success in catching two out of them immediately while other one we caught from Rithala area," he added. According to police sources, those who escaped were under trial in cases like robbery, rape and arms act. Following the jailbreak, all inter-states borders with the Capital have been sealed and intense search have been launched to trace the inmates. The names and case history of the 12 inmates are yet to be disclosed.

CBI chellenges Rajiv Gandhi assassination case order (Go To Top)

     New Delhi: The Central Bureau of Insvestigation (CBI) Director P C Sharma, heading the Multi Disciplinary Monitoring Agency (MDMA), has moved to the Supreme Court in former Prime Minister Rajiv Gandhi's assasisnation case challenging the Madras High Court's previous order releasing pro Sri Lankan nationals suspected to have played key roles in it in 1991. The Special Leave Petition (SLP) filed by the Director challenging the April 25 order of the High Court stated that the suspects, Lingam and Vasanthan, had played an important role in the assassination of Rajiv Gandhi. "It has come to light during the course of investigation by SIT as well as that of MDMA, that the respondents are closely associated with LTTE," the appeal stated while seeking stay of the High Court order. The appeal said the Memorandum of Action taken by the Central Government on the Jain Commission report envisaged the setting up of MDMA in the CBI to further investigate the roles of 21 suspects in the Rajiv assassination case. The names of Lingam and Vasanthan were not included among the 21 accused listed in the Memorandum of Action Taken. The MDMA while investigating into the activities of the suspects concerned had come across information, which led to suspicion that the present respondents had important roles to play in the assassination of Rajiv Gandhi.

     The CBI, in its appeal, stated that it had come to light during the course of investigations that Lingam used to hold "secret discussions with Sivarasan." Sivarasan is the one-eyed key accused in the case who had committed suicide on being cornered by SIT, and other LTTE cadres. The MDMA found out that "Lingam had also received the 9-member killer squad consisting on its arrival at Kodaikkarai on May 1, 1991 to assassinate Rajiv Gandhi," the agency said. The squad included Sivarasan, Dhanu alias Anbu, Subbha alias Nithya, Neru alias Gokul, Suthandiraja alias Santhan, Shankar alias Koneswaran, Vijayanandan alias Hariyya, Ruban alias Suresh and driver Anna alias Keerthi. On the role of Vasanthan, the CBI alleged he had "actively participated in arranging for the accommodation of Sivarasan, Subha and Neru at Bangalore after the assassination of Rajiv Gandhi on May 21, 1991 at Sreeperambudur." The agency said the MDMA, apart from conducting detailed investigations in India, has also sent a Letter Rogatory (LR) to Sri Lanka on April 23, 2001 through Designated TADA Court, Chennai. In the letter, the MDMA has asked for investigation there on the roles played by the suspects, including Lingam and Vasanthan.

     Detailing the steps taken on investigating the case and the suspects, the CBI assailed the High Court order which had released the two suspects on the ground that no effective steps had been taken by the MDMA to complete its probe. The CBI said the respondents were Sri Lankan nationals and it would be extremely difficult to secure their presence after their release and subsequent departure to Sri Lanka. Rajiv was assassinated, whilst campaigning in favour of a UCPI candidate for the upcoming parliamentary elections in Tamil Nadu, by the suicide bomber Thenmuli Rajaratnam A.K.A Dhanu. Dhanu, widely believed to be have been a LTTE member. In 1998, the court convicted 26 people in the conspiracy to assassinate Gandhi. The conspirators, who consisted of Tamil militants from Sri Lanka and their Indian allies, had sought to stop Gandhi from getting elected in the then upcoming elections. They wanted to stop him from sending Indian troops into Sri Lanka as he had done in 1987 (when he survived an assassination attempt in Sri Lanka while inspecting the honor guard) to help enforce a peace accord. Those troops had ended up fighting the Tamil separatist guerrillas. His death brought the Congress Party back into power in the 1991 general election on a similar wave of feeling as had followed his mother's assassination in 1984.

Stray incidents mark BJP's nationwide bandh call (Go To Top)

     Jamshedpur/Indore/Ranchi: Road, rail and air services were affected in some parts of the country in response to the bandh call given by the BJP and the VHP against yesterday's militant attack on Ram temple at Ayodhya. At least six militants allegedly belonging to the Lashkar-e-Toiba (LeT) had intruded into the temple premises by blowing off the main entry gate and opened indiscriminate firing on the devotees. A gun battle ensued between the security men and the terrorists in which a woman devotee and all the militants were killed. Venting out their anger against the gruesome attack, hundreds of BJP and Shiv Sena workers squatted on the tracks at Tatanagar station. As a result, the Puri-New Delhi Purusotham Express and Tata-Howrah Steel Express were detained at Tatanagar, while the services in Chakradharpur division of South-Eastern Railway were paralysed. In Orissa train services were affected and educational institutions seen closed at many places. Angry protesters disrupted rail traffic as the 6003 Howrah-Chennai mail was stopped at Chatrapur station and 8003 Howrah-Yashwantpur Express, 220 Palasa-Bhubaneswar DMU at Berhampur railway station, official sources said. In Baripada, the bandh supporters blocked the National Highway No. 5 since 6 a.m. In Indore, BJP and VHP workers damaged the VIP lounge of the local airport and caused delay in departure of a Mumbai-bound flight during saffron-sponsored bandh, the police said. In Ranchi, BJP activists shouted slogans against the Congress-led UPA government and Mulayam Singh Yadav-led state government in Uttar Pradesh demanding resignation of the both. In Nagpur, BJP and VHP activists burnt an effigy of the UPA government even as security forces stepped up vigil at government and military facilities, nuclear power stations, temples and mosques.
